Terms of Service

1. Acceptance
These Terms of Service ("Terms") govern your access to and use of My Studio Art (the "Service"), operated at mystudioart.com. By using the Service, placing an order, or otherwise interacting with the site, you agree to these Terms and our Privacy Policy, Refund Policy, Shipping Policy, and Content & IP Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By placing an order you represent that you meet this requirement and have the legal capacity to enter a binding contract.
3. The Service
My Studio Art is a custom 3D printing service. You submit a text prompt (and optionally a reference image). Our system generates a 3D model preview. You select color, size, material, and add-ons. We then 3D print the model and ship it to you. Each print is custom and made to order.
4. Orders, pricing, payment
Prices are shown at checkout in US Dollars and are subject to change. Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, or cancel any order at our discretion (for example, due to suspected fraud, prohibited content, unprintable geometry, or stock issues).
Payment is processed by Shopify Payments. By submitting payment you authorize the charge and confirm the payment method belongs to you.
5. Prompts and prohibited content
You are solely responsible for prompts, reference images, and other content you submit. By submitting content, you represent that you have the right to do so and that the content does not violate this Section 5.
You must not submit prompts or images that:
- Are illegal under US or applicable local law.
- Infringe any third party's intellectual property, including copyrighted characters, logos, brand marks, or proprietary designs.
- Depict or describe real, identifiable people without their documented consent.
- Are sexually explicit, pornographic, or depict nudity of any minor (we report suspected CSAM to NCMEC).
- Promote hate, violence, harassment, self-harm, or terrorism.
- Describe weapons, weapon components, or functional firearm parts.
- Contain malware, exploits, or attempts to manipulate our systems.
We reserve the right to refuse, cancel, or refund any order whose prompt or output we determine violates this section, in our sole discretion. Repeat or severe violations may result in account-level bans. See our full Content & IP Policy.
6. Intellectual property
Your content. You retain ownership of the prompts, reference images, and other content you submit. By submitting content, you grant My Studio Art a worldwide, non-exclusive, royalty-free license to: (a) use the content to generate, review, print, and ship your order; (b) retain the content for support, fraud prevention, and legal compliance purposes; and (c) use anonymized prompts to improve the Service (with no AI model training).
Output. When you receive a delivered physical print, you own that physical object. The associated AI-generated 3D mesh file (GLB/STL) is licensed to you for personal, non-commercial use only. We retain ownership of the mesh and reserve the right to use, reproduce, and display anonymized prompt-to-mesh data for portfolio, marketing, and Service-improvement purposes unless you opt out at support@mystudioart.com within 30 days of delivery.
No AI training. We do not use your prompts, images, or output meshes to train any AI model, ours or a third party's.
Our marks. "My Studio Art" and the Strata logo are trademarks of the operator of this Service. You may not use them without prior written permission.
7. Production, shipping, delivery
See our Shipping Policy. Production time varies (typically 1 to 7 business days). Delivery times are estimates only. Title and risk of loss pass to you upon carrier handoff.
8. Refunds and cancellations
See our Refund Policy. Custom 3D prints are made to order; cancellation is possible only before production starts. We reprint or refund for defects and shipping damage subject to that policy.
9. Acceptable use
You will not: (a) reverse engineer, decompile, or attempt to extract source from the Service; (b) use automated scraping tools or AI agents to interact with the Service except in compliance with our robots.txt and posted Agent terms; (c) impersonate others; (d) interfere with or disrupt the Service; (e) circumvent rate limits, access controls, or security features.
10. Disclaimer of warranties
THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI WILL PRODUCE A PARTICULAR RESULT FROM ANY PROMPT, OR THAT PRINTS WILL EXACTLY MATCH THE PREVIEW.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MY STUDIO ART AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.
12. Indemnification
You agree to indemnify, defend, and hold harmless My Studio Art from any claims, damages, liabilities, and expenses (including reasonable attorney fees) arising from: (a) your breach of these Terms; (b) your content (including prompts and reference images); (c) your violation of any law or third-party right.
13. DMCA & takedown
If you believe content on or produced by the Service infringes your copyright, send a notice to support@mystudioart.com including: (i) your contact details; (ii) the work claimed to be infringed; (iii) the allegedly infringing material; (iv) a statement of good faith belief; (v) a statement under penalty of perjury that you are authorized to act. We respond within a reasonable time and may remove content or cancel orders pending resolution.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Sections that by their nature should survive (IP, disclaimers, limitations, indemnification, governing law) will survive termination.
15. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will post the updated date at the top of this page.
16. Governing law & disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflicts of law. You and My Studio Art agree to submit to the exclusive jurisdiction of state and federal courts located in Duval County, Florida for any dispute arising from these Terms or the Service, except where applicable consumer protection law gives you the right to bring proceedings in your country of residence.
17. Agents and automated access
AI agents and automated tools that access the Service must identify themselves accurately in the User-Agent string and respect the rules in our robots.txt. Agents may not impersonate humans, complete CAPTCHAs, or evade controls intended to distinguish humans from machines.
